By downloading and installing software by Internet Marketing Service, you acknowledge to have read, understood and agree with the following terms:

1. The software may be freely copied and installed on your own computers as many times as you wish. However, installing it on multiple computers or a network for simultaneous use by more than one user requires multiple licenses to be purchased after the end of the 30-day trial period.

The user of products by Internet Marketing Service can expect good software, but there is no guarantee that these tools are error-free, work uninterrupted, or that they may not have unwanted side-effects on the operation of other programs or the computer system’s stability and security.
The company expressly disclaims all other warranties.

3. This licence agreement cannot be limited, modified or extended by other oral or written information.

In no event will Internet Marketing Service be liable to customer or any other party for damages of any kind arising from downloading, installing, or using his software. The user takes over the full responsibility for the downloaded program.
5. Right of withdrawal – order cancelation rights according to German law (Widerrufsbelehrung)

The customer is entitled to revoke the contract within two weeks without giving reasons in written form (e.g. letter, fax, e-mail) or by sending back the article. The termination period shall commence upon receipt of this notification in writing however not before receipt of the goods by the buyer. Notice of cancellation must be received in written form on or before the appropriate date. The notice of cancellation must be addressed to Internet Marketing Service, Inh. Thomas Peemöller, info@ims-server.de, Sandweg 138 a, 25336 Klein Nordende, Fax 04121/788365.

Cancellation consequences
In the event of a valid revocation of this agreement each party shall return to the other the benefits received. In case the customer cannot return entirely or in a worsened case the benefits received to Internet Marketing Service, he is obliged to value replacement to Internet Marketing Service. That doesn’t apply when a worsened state is exclusivlely caused by trying it  – as it would have been possible trying it in a shop.
The customer is not obliged to provide value replacement if he doesn’t use the item like an owner and omits everything that affects its value.
Articles that can be sent back in a package or a letter have to be returned. The customer has to pay shipping when returning a delivery whose value amounts up to 40 Euros, if delivered goods correspond to the goods ordered.
Otherwise shipping is free. Articles that cannot be sent in a package or letter are picked up at the customer’s house.

Restriction of the right of withdrawal
Corresponding to § 312, para. 4, nr.2 BGB, the software is not subject to revocation in case that record carriers were unsealed. Delivering an activation key or in case of online delivery (e.g. when sending with e-mail or via download)  the right of withdrawal does not apply, either, as the data submitted cannot be sent back because of their state (§ 312, para. 4, nr.2 BGB). That also applies to goods which were made according to the customer’s wishes.
